Express Terms of Use

This Terms of Use (this “Agreement”) sets forth the terms and conditions that apply to: (i) your access and use of the internet website owned and operated by Encorp Pacific (Canada) (“Encorp”, “we”, “us” or “our”) and currently located at express.return-it.ca (the “Site”); and (ii) your participation in the “Return-It Express System”.

Your use of the Site constitutes your agreement to follow and be bound by this Agreement. We reserve the right to modify this Agreement at any time in our sole discretion without prior individual notice. Any modifications to this Agreement will be posted on the Site. For this reason, we encourage you to review this Agreement whenever you access and use the Site. You can tell when this Agreement was last modified by checking the "last updated" date that appears at the top of this Agreement.

The amendments to this Agreement will take effect 30 days after the date on which we provide notice of the amended version. Prior to that date, the previous version of this Agreement will continue to apply. If you disagree with any amendments, you may terminate this Agreement by completing the termination procedures on the Site or by calling 1-855-350-2345 Monday to Friday from 9:00 am (PST) to 5:00 pm (PST) and completing the termination procedures over the phone at any time within the 30-day period before the amendments take effect. If you do not complete the termination procedures during that time, then you are considered to have accepted the proposed amendments.

By using the Site or the Return-It Express System or clicking on the “I Accept” or similar button included at the end of this Agreement, you are indicating your acceptance to be bound by this Agreement. If you do not accept this Agreement, you must not use the Site or the Return-It Express System.

If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms and conditions, in which case the terms “you” and “your” will refer to such entity. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this Agreement and may not use the Site.

By accepting this Agreement, you agree to be bound by the terms and conditions of this Agreement, as well as our privacy policy, which can be viewed by clicking on the “Privacy Policy” link located on the Site (the “Privacy Policy” https://www.return-it.ca/about/privacy-policy/ ) and our video surveillance policy, which can be viewed by clicking on the “Video Surveillance Policy” link located on the Site (the “Video Surveillance Policyhttps://www.return-it.ca/express/video-surveillance/ ), both of which may be amended from time to time in the future.

Ability to Enter into this Agreement

In order to enter into this Agreement, you must not be an owner, operator, employee, investor in or otherwise have a financial interest in any Encorp licensed collection facility, including any Return-It depot. You must also have reached the legal age of majority in your jurisdiction of residence or possess legal parental or guardian consent, and you must be fully able and competent to enter into the terms and conditions of this Agreement, and able to abide by and comply with this Agreement. If you accept this Agreement, you expressly represent to Encorp that you meet all of these requirements.

How the Return-It Express System Works

The Return-It Express System provides the following options for returning used beverage containers:

  • drop bags of used beverage containers at a participating Return-It depot;
  • drop bags of used beverage containers at a Return-It Express & GO location;
  • drop bags of used beverage containers at a Express Plus location.

These options are provided via the Site. For the purpose of this Agreement, Return-It Locations means, collectively, Express & Go containers, Express Plus locations and participating Return-It depots.

Users must register with the Site prior to using the Return-It Express System. Upon registration on the Site, you create a unique on-line account. A valid phone number is required to create your unique identifier which allows you to access certain areas of the Site and prepare labelled bags that are linked to your on-line account (“labeled bags”), including by generating QR-coded bag labels from the Express kiosk at Return-It Locations or by such other means as Encorp may make available from time to time. Your phone number will be used for two-factor authentications (2FA) to verify your identity when you log into your on-line account to review transaction history and request redemptions. We reserve the right to refuse any registration you place with us and may, in our sole discretion, limit or cancel your registration.

After creating your on-line account for the Site, you may return used beverage containers at Return-It Locations in labeled bags.

To prepare labeled bags using the Express kiosk at participating Return-It Locations, you may print up to 6 QR-coded bag labels at any one Return-It Location Express kiosk per day. You have the ability to prepare QR-coded labeled bags at home by taking these QR-coded bag labels home and labeling your bags in advance. At Return-It Locations, you may also apply the QR-coded bag label to your bag, ensuring it is readable. Each bag requires its own QR-coded bag label. You are required to use a regular transparent (blue, clear, or other color as long as they are transparent) recycling bags which can be purchased at most grocers, drug, or hardware stores. The bags must be transparent so the contents are visible. If a non-transparent bag is used, your on-line account may not be credited. You may drop off a maximum of 6 labeled bags at a Return-It Location per visit.

At Return-It Locations equipped with Scan-In procedures you are required to “scan in” your labeled bags using the provided scanner to verify the Return-It Express Location’s receipt of your labeled bag. This will record the date and time your labeled bag was dropped off and will help track the labeled bag as it moves through the Return-It Express System. If you fail to scan-in at one of these locations, you will receive a warning message reminding you that the location requires you to scan-in your labeled bag. You may not claim that any labeled bag not scanned in at these locations for verification of drop-off has not been properly counted and credited to your on-line account.

Once you drop off your labeled bag(s), they will be counted and sorted. You will be notified via an email when your labeled bags(s) have been counted. Each Return-It Location at which you dropped off one or more labeled bags, or at which your labeled bags are counted and sorted will credit your on-line account, or will cause your on-line account to be credited, within ten business days with:

  1. the full posted deposit amount on all used beverage containers acceptable within the Return-It Program — a detailed list of acceptable products and their deposit value is listed at https://www.return-it.ca/beverage/products; and
  2. the posted rate at the Return-It depot where the labeled bag was dropped off or counted and sorted, for refillable beer bottles and beer cans, either of which are not part of the Return-It Program. The user acknowledges that the rates for used beverage containers that are not part of the Return-It Program may vary by participating Return-It depot location and may change over time and may not be established by Encorp but by the independently owned and operated Return-It depot owners.

Return-It Express is committed to using commercially reasonable efforts to accurately count used beverage containers. All counts are considered final, and you agree to abide by the count and waive any and all rights you may have to dispute any count.

Subject to the minimum amounts set out below, upon your request, the funds in your on-line account representing refunded deposits for used beverage containers dropped off at Return-It Locations by the account holder, will be paid out by cheque or Interac e-Transfer or other redemption options that may be available from time to time, as you elect through the Site. We reserve the right, at any time in our sole discretion, to make changes to the redemption options available on the Site, provided however, your right to have the funds in your on-line account, representing refunded deposits for used beverage containers dropped off at Return-It Locations by the account holder, paid out by cheque shall always remain available to you subject to the minimum amounts set out below.

The Return-It Express System is for used beverage containers only. If you place garbage, containers not accepted within the Return-It Program or other foreign materials in your labeled bags, you may be subject to a disposal and handling fee of $1.00 per bag containing such materials.

Once the labeled bag(s) are counted, you can log into your on-line account and see the record for the entire contents of the labeled bag(s) you dropped off, or had picked up, as well as the value of the deposit refund.

There are three types of accounts to choose from under the Return-It Express System:

  • Personal accounts: Collecting the deposit refunds on behalf of an individual, household, or family. Personal accounts are intended for typical household volumes. For example, a family of 4 who returns 1 or 2 labeled bags per week of used beverage containers from their household.
  • Group accounts: Collecting the deposit refunds on behalf of fundraising groups & bottle drives; community groups & schools. For example, a sports team from a school who is running a bottle drive to raise funds for an out-of-town tournament.
  • Business accounts: Collecting the deposit refunds on behalf of a business or organization with a legal business name or registered business number. For example, an account opened by a business to return used beverage containers collected in their office.

Personal account holders with atypically large volumes of used beverage containers, as determined by Encorp, may be required to change to a group account or business account and receive payment via cheque.

For personal and group accounts, funds can be redeemed either by cheque or Interac e-Transfer. A minimum amount of CDN $50.00 is required before a cheque can be requested and issued. Cheques may take up to two weeks for delivery. To redeem by Interac e-Transfer, a minimum amount of CDN $10.00 is required. For personal and group accounts a maximum value of $2,000.00 can be redeemed and refunded by Interac e-Transfer within a 12-month period. Any funds redeemed in excess of $2,000.00 within a 12-month period can only be refunded by cheque to the mailing address on the account file.

We reserve the right to modify the amount of the threshold for Interac e-Transfer redemptions on 30 days’ notice. Any Interac e-Transfer that is not collected by you within 30 days of sending will be cancelled automatically. We reserve the right to change how any specific amount is paid or to cancel a transaction at any time.

For business accounts, funds can only be redeemed by cheque. A minimum balance of $50.00 is required before a cheque can be requested and issued. Cheques may take up to two weeks for delivery. The Interac e-Transfer service is not available for business accounts.

There are no cash payments issued by the Express Return-It System at the Return-It Location at which you dropped off your labeled bags. For any inquiries or concerns with your on-line account, you can call 1-855-350-2345 Monday to Friday from 9:00am (PST) to 5:00pm (PST).

Termination, Modification and Suspension of the Express Services

You may terminate your on-line account(s) by completing the termination procedures on the Site or by calling 1-855-350-2345 Monday to Friday from 9:00 am (PST) to 5:00 pm (PST) and completing the termination procedures over the phone. If you terminate your on-line account(s) on the Site, subject to the other terms of this Agreement, the funds in your on-line account will be paid out by cheque or Interac e-Transfer. If you terminate your on-line account(s) over the phone, subject to the other terms of this Agreement, the funds in your on-line account(s) will be paid out by cheque. Any funds paid out upon termination of your on-line account(s) are not subject to the minimum amount requirements set out in this Agreement.

Encorp reserves the right to terminate any on-line account, without notice at any time and for any reason including, but not limited to: (a) a failure to comply with the terms of this Agreement; (b) if you engage or encourage or assist others to engage, in any misleading, fraudulent, improper or unlawful or dishonest act relating to this Agreement, as determined in Encorp’s sole discretion; and (c) you are or are likely to become an owner, operator, employee, investor in or otherwise have a financial interest in any Encorp licensed collection facility, including any Return-It depot, at any time. Encorp reserves the right to modify, suspend or terminate the Site or the Return-It Express System, without notice at any time and for any reason.

Subject to the other terms of this Agreement, if Encorp terminates your on-line account, the Site or the Return-It Express System, all funds in your on-line account as of the date of termination will be issued to the account holder by cheque.

If your on-line account becomes inactive and Encorp has made commercially reasonable efforts to contact you using the contact information provided for your on-line account, then all funds in your on-line account at the time the account becomes inactive will be forfeited to Encorp. An on-line account becomes inactive when the account has not been accessed and no labeled bags have been credited to the account for a period of at least two years.

Except for the payment of funds in your on-line account as provided for above, you agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of your on-line account, the Site or the Return-It Express System, including any withdrawal of funds in your on-line account if the account becomes inactive.

Encorp’s Role

Subject to certain Return-It Locations owned by Encorp, Encorp acts solely as a facilitator of the Return-It Express System for Return-It Locations. The Return-It depots are independent contractors. You acknowledge that the deposits and rates payable to you for used beverage containers dropped off at Return-It Location(s) in labeled bags pursuant to the Return-It Express System are payable to you by Encorp upon the used beverage containers being credited to your on-line account. ENCORP SHALL NOT BE LIABLE FOR CLAIMS, LOSSES, DAMAGES, COSTS, EXPENSES, DELAYS OR LOSS OF ENJOYMENT OF ANY NATURE OR KIND WHATSOEVER, TO YOU OR YOUR PARTICIPANTS, RESULTING FROM THE ACTS, OMISSIONS OR NEGLIGENCE OF RETURN-IT DEPOTS OR OF ANYONE OTHER THAN US OR OUR EMPLOYEES ACTING APPROPRIATELY ON OUR BEHALF.

Site Transactions

We reserve the right to refuse any registration you place with us. We may, in our sole discretion, limit or cancel your registration. In the event we make a change to or cancel a registration or order, we will attempt to notify you by contacting the e-mail and/or address and/or phone number provided at the time the registration was made.

User Conduct

You must not use the Site in any way that causes, or is likely to cause, the Site or access to it to be interrupted, damaged or impaired in any way. You understand that you are responsible for all electronic communications and content sent from your computer to us and you must use the Site for lawful purposes only. Certain portions of the Site may allow you to forward material by email to addressees specified by you. By using this capability, you represent, warrant and confirm that you have the consent of every recipient to send such emails, you will only do so in compliance with all laws (including all laws related to the sending of email, texts or other electronic messages).

If you submit, post, distribute or upload content, you will ensure the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam". Harassment in any manner or form on the Site, including via e-mail or by obscene or abusive language is strictly prohibited. Impersonation of others, including an Encorp employee or other members or users on the Site is strictly prohibited. You must not upload to, distribute, or otherwise publish through the Site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, or which may constitute or encourage a criminal offence, violate the rights of any party or otherwise give rise to liability or violate any law. You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization.

Site Content

All right, title, interest and ownership and intellectual property rights in and to the Encorp logos, including without limitation Encorp’s Express and Express & GO logos, and the Site, including but not limited to its “look and feel” (e.g., text, graphics, images, logos, buttons, icons and the placement and layout thereof), images, video, audio, data, content, software (including html-based computer programs) and other media, material or information (collectively, “Content”) are and will remain the property of Encorp or its software or content suppliers. The Site is protected under Canada, United States and international copyright, trademark and other laws and treaties.

The Site and the Content are intended solely for personal, non-commercial use. You may download or copy the Content displayed on the Site for your personal use only. No right, title or interest in any downloaded Content is transferred to you as a result of any such downloading or copying. You will not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the Content or the Site.

User Comments, Feedback, and Other Submissions

You acknowledge that any ideas, suggestions, feedback or other submissions which you provide to Encorp related to the Site or Encorp or its services or business (“Feedback”) shall become Encorp’s property without any compensation or other consideration payable to you by Encorp, and you do so of your own free will and volition. Encorp may or may not, in its sole discretion, use or incorporate the Feedback in whatever form as Encorp may decide, into the Site, its events, products, services, or business. You hereby assign all rights on a worldwide basis in perpetuity to Encorp in any Feedback and, as applicable, waive any moral rights thereto.

Personal Information Submitted Through the Site

Your submission of personal information through the Site is governed by our Privacy Policy. This Agreement incorporates by reference the terms and conditions of the Privacy Policy. You hereby represent and warrant to us that you have obtained all necessary permissions and consents to provide us the personal information which you have provided, and for all of the purposes contemplated by the Site.

Errors, Inaccuracies, and Omissions

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information if any information on the Site is inaccurate at any time without prior notice.

Occasionally there may be information on your on-line account that contains typographical errors, inaccuracies, or omissions, including funds that were inappropriately credited to your on-line account. We reserve the right to correct any error, inaccuracies or omissions, including the deduction from your on-line account of any funds improperly credited to your on-line account, upon prior notice. You expressly waive any and all rights to any funds improperly credited to your on-line account and agree that such funds may be deducted from your on-line account at any time.

We reserve the right to withhold payment of any funds in your on-line account until we have determined that all funds in your on-line account were properly credited to your on-line account.

Lost Labeled Bags

If after counting and sorting the used beverage containers returned to a Return-It Location in a labeled bag, it cannot be determined which on-line account the used beverage containers should be credited to, the associated deposits and rates for such used beverage containers will be credited to the lost bag account held by Encorp.

If you have returned used beverage containers to a Return-It Location in a labeled bag and believe the funds for such used beverage containers have not been appropriately credited to your on-line account, you may contact Encorp to discuss this matter. Encorp will then determine, based on available evidence, whether there needs to be an adjustment to the funds in your on-line account to account for used beverage containers that were not properly credited to your on-line account.

If used beverage container deposits and rates credited to the lost bag account have not been claimed for a period of two years, these funds will be forfeited to Encorp and deducted from the lost bag account.

Links to Other Web Sites and Services

The Site may permit you to link to other websites or resources on the Internet, and other websites or resources may contain links to the Site. These other websites are not under Encorp’s control, and you acknowledge that Encorp is not responsible or liable for any third-party content, including but not limited to the accuracy, integrity, quality, usefulness, legality, appropriateness, safety or intellectual property rights of, or relating to, such third-party content or any other aspect of such websites or resources. The inclusion of any such link does not imply endorsement by Encorp or any association with its operators. You further acknowledge and agree that Encorp shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, goods or services available on or through any such website or resource. Access and use of third party sites, including the information, material, products and services on third party sites or available through third party sites, is solely at your own risk.

User Account Information

You are responsible for ensuring your on-line account has your most current email, phone number and mailing address. You will provide true, accurate, current and complete information about yourself, and you agree not to misrepresent any information provided for your on-line account or any affiliation you may have with Encorp. Encorp is not responsible for notifications or payments you do not receive because of a change in your contact information that is not updated or reflected on your on-line account.

Passwords

You are solely responsible for maintaining the confidentiality of your password and on-line account information, if any. You must notify us immediately in the event of any known or suspected unauthorized use of your on-line account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your or anyone else’s password. You are solely responsible for any and all activities which occur under your on-line account. You agree to immediately notify us of any unauthorized use of your on-line account or any other breach of security known to you. If electronic fraud or identity theft has occurred, Encorp will, upon notification or discovery, suspend your on-line account until ownership can be confirmed.

Safety & Security

Certain Return-It Locations are under video surveillance for security and safety purposes. Video surveillance is used for the protection and safety of employees, customer occupants, assets and property. Please review the Encorp Video Surveillance Policy and the Privacy Policy for additional details.

Disclaimer

YOUR USE OF THE SITE AND ALL CONTENT FORMING PART OF OR RELATED TO THE SITE ARE YOUR SOLE RESPONSIBILITY AND AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ENCORP EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND WITH RESPECT TO THE SITE, WHETHER EXPRESS OR IMPLIED.

ENCORP DOES NOT WARRANT THAT THE SITE OR ANY FUNCTION CONTAINED IN THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

ENCORP EXPRESSLY DISCLAIMS ANY DUTY TO UPDATE OR REVISE THE CONTENT OF THE SITE, ALTHOUGH WE MAY MODIFY THE CONTENT AT ANY TIME WITHOUT NOTICE. YOUR USE OF THE SITE IS AT YOUR SOLE RISK, AND YOU ASSUME FULL RESPONSIBILITY FOR ANY COSTS ASSOCIATED WITH YOUR USE OF THE SITE. ENCORP SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND RELATED TO YOUR USE OF THE SITE.

ENCORP DOES NOT REPRESENT OR WARRANT THAT THE SITE, OR ANY PART THEREOF, IS APPROPRIATE OR AVAILABLE FOR USE IN ANY PARTICULAR JURISDICTION. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ENCORP AND ITS AFFILIATES AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF, OR RESULTING FROM, (A) THE USE OR THE INABILITY TO USE THE SITE; (B) THE USE OF ANY CONTENT OR OTHER MATERIAL ON THE SITE OR ANY WEBSITE OR WEBSITES LINKED TO THE SITE, (C) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SITE; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (E) STATEMENTS OR CONDUCT OF ANY THIRD-PARTY ON THE SITE; OR (F) ANY OTHER MATTER RELATING TO THE SITE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, OR OTHERWISE) EXCEED CDN$50.00. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SITE.

YOU HEREBY WAIVE ANY RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR HAVE A TRIAL BY JURY FOR ANY MATTER, DISPUTE, PROCEEDING OR ACTION ARISING OUT OF, OR RELATED TO, THIS AGREEMENT.

Indemnification

You agree to defend, indemnify and hold Encorp and its affiliates and each of their respective contractors, agents and representatives harmless from and against any and all claims, damages, costs and expenses, including legal fees, suffered or incurred by any of them, directly or indirectly, arising from or related to your use of the Site, the Return-It Express System and/or your breach of any representation, warranty, condition or other provision of this Agreement.

Governing Law

If there is any dispute between you and Encorp about or involving this Agreement or the Site, you hereby agree that the dispute shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sales of Goods shall not apply to this Agreement. You hereby agree to submit to the exclusive jurisdiction of the courts in Vancouver, British Columbia with respect to any claim, proceeding or action relating to or otherwise arising out of this Agreement or the Site, howsoever arising, provided always that Encorp may seek and obtain injunctive relief in any jurisdiction.

Waiver

The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of Encorp's right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.

Assignment

Encorp may assign its rights and obligations under this Agreement. This Agreement will ensure to the benefit of Encorp's successors, assigns and licensees. You will be notified by email to the email address specified in your on-line account if Encorp assigns its rights and obligations under this Agreement, and thereupon you agree to release Encorp of any and all of its obligations to you under these terms and look solely to the assignee in respect of any obligations Encorp may have to you under these terms.

Termination

These terms are effective unless and until terminated by either you or Encorp. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes, and any obligations and liabilities hereunder with respect to an order submitted prior to the termination date shall continue to apply to such order notwithstanding any termination. This section and the sections entitled “User Comments, Feedback, and Other Submissions”, “Personal Information Submitted Through the Site”, “Links to Other Web Site and Services”, “Disclaimer”, “Limitation of Liability”, “Indemnification” and “General”, and any other sections which ought reasonably to survive the termination of this Agreement shall survive any actual or purported termination or expiry of this Agreement.

Severability

The terms and conditions of this Agreement shall be deemed severable. In the event that any provision of this Agreement is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by law and such determination shall not affect the validity or enforceability of any other remaining provisions.

Entire Agreement

The terms in this Agreement, together with the Privacy Policy and the Video Surveillance Policy constitute the entire Agreement between Encorp and you regarding the subject matter of this Agreement and supersede all prior or contemporaneous communication, whether electronic, oral or written between Encorp and you with respect to such subject matter. In the event of a conflict between this Agreement the Privacy Policy or the Video Surveillance Policy, this Agreement shall prevail followed by the Privacy Policy.

Phishing – Protecting Your Information

Phishing is the fraudulent attempt to obtain sensitive personal information such as usernames, passwords or credit details. Phishing can come in the form of an email, text, and/or phone call and appear to be from a legitimate company. If you receive an Interac e-Transfer notification that you were not expecting, please do not open it. Interac e-Transfers will only be sent to you from Encorp Pacific (Canada) if you have requested to redeem funds from your online account. Education and due diligence is the best way to safeguard yourself against financial fraud. Express & GO

All usage parameters and expectations for the Return-It Express System apply to Express & GO locations. Labeled bags must be used.

Safety & Security

The Express & GO system is designed for both safety and reliability. If Encorp’s analysis of surveillance footage proves a breach in security at the Express & Go container, resulting in stolen or missing labelled bags, Encorp will investigate and make reasonable commercial efforts to ensure the owners of these labelled bags are fairly compensated.

Accessing an Express & GO Container

Upon registration on the Site, each on-line account will be provided with a unique alphanumeric passcode. Any registered Express user can access the Express & GO system using their unique alphanumeric passcode and the phone number and keypad on any Express & GO container door. At any Express & Go location Express users can text their unique alphanumeric passcode to the phone number provided on the Express & Go container door, after which they will receive a text message with a PIN code that can be used at that Express & Go container, via the keypad, to unlock the drop-off window. The PIN code can only be used to access the Express & Go container with the phone number that you texted and will expire shortly after you have received it.
