Contest Rules & Regulations

NO PURCHASE NECESSARY. THE FOLLOWING CONTEST IS INTENDED FOR PLAY AT PARTICIPATING RETURN-IT DEPOTS IN BRITISH COLUMBIA, CANADA ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO CANADIAN LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT A RESIDENT OF BRITISH COLUMBIA. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST HAVE REACHED NINETEEN (19) YEARS OF AGE AT TIME OF ENTRY. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE OFFICIAL CONTEST RULES.

ELIGIBILITY

To be eligible to enter this contest (the “Contest”), an individual must: (i) be a legal resident of British Columbia and (ii) have reached nineteen years of age at the time of entry. Employees, representatives and agents of Encorp Pacific (Canada) (the "Sponsor"), the Sponsor’s parents, affiliates and subsidiaries, its advertising and promotional agencies, Depot owners or Depot staff and any person or entity involved in the production, implementation, administration or fulfillment of the Contest, and members of the immediate family or household of any of the above, are not eligible to participate in the Contest. In these Official Contest Rules (“Rules”), "immediate family" means husband or wife, mother, father, brothers, sisters, sons and daughters.

HOW TO ENTER

The Contest begins at 8:00 AM Pacific Time ("PT") on April 29, 2012 and closes at 6:00 PM PT on September 3, 2012 (the "Entry Period"). No purchase is necessary to enter the Contest. To enter the Contest, complete the official entry form in full and deposit the completed entry form, available at any participating Encorp Pacific Return-It Depot, in the entry box provided at such Depot.

Participating Depot Locations are as follows:

LIMIT of one entry per person and per household per day during the Entry Period. Multiple entries at different locations on the same day will be disqualified. All entries must be submitted no later than the end of the Entry Period.

All entries become the property of the Sponsor and none will be returned. Entries will only be accepted at participating Encorp Pacific (Canada) Return-It Depots. No entries will be accepted by any other means, including but not limited to email. Illegible, incomplete, late, or garbled entries will be disqualified.

WINNER SELECTIONS

On or around September 30, 2012 at #206 - 2250 Boundary Rd., Burnaby, British Columbia, three (3) separate random draws will be conducted, one for each of the prizes, by a representative of the Sponsor. All eligible entries received throughout the entry period at all participating depots will be included in the draws. Only one (1) prize can be won per household in this Contest, regardless of where household members’ entries were entered. Odds of being selected are dependent upon the number of eligible entries received throughout the Entry Period at all participating Return-It Depot locations.

 PRIZES

The following three (3) prizes are available to be won:

1. The one (1) Grand prize is a 2012 Smart fortwo coupé with an approximate value of seventeen thousand dollars ($17,000).
2. The one (1) second prize is two (2) Vespa scooters (model #  S50 CC), with a total approximate value of nine thousand dollars ($9,000).
3. The one (1) third prize is two (2) NORCO mountain bikes (model # VFR 4) and one (1) $100 gift card to Canadian Tire. The approximate retail value of the third prize is $1,000.

Prizes must be accepted as awarded and cannot be transferred, substituted or redeemed for cash. Sponsor reserves the right, in its sole discretion, to substitute any and all of the prizes for a prize of equal or greater value should all or part of the prize become unavailable for any reason.

Delivery of prizes will be coordinated with the winners after each selected entrant has been successfully contacted, complied with all Rules and related requirements and been declared a winner.

Winner Responsibilities: For the first and second prize, all cost associated with claiming and taking ownership of the prize including but not restricted to licensing, insurance, registration and any cost or expense associated with taking delivery of the prize, are the responsibility of the winner.

1. CONDITIONS OF WINNING
2. Before being declared a winner of any prize in this contest, each selected entrant will be required to answer, without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question posed during a pre-arranged telephone call, and to comply with all these Rules. The prizes are not transferable or convertible to cash and must be accepted as awarded.
3. Selected entrants will be notified by phone and must respond within forty-eight hours of notification. Upon notification, each selected entrant must respond by telephone to the contact number provided in the notification and the selected entrant’s response must be received by Sponsors within forty-eight hours of such notification. If a selected entrant does not respond in accordance with these Rules or the selected entrant is unwilling or unable to comply with these Rules, he/she will be disqualified and will not be eligible to receive a prize and another entrant will be selected for that prize. Sponsor is not responsible for the failure for any reason whatsoever of selected entrant to receive notification or of Sponsor to receive selected entrant's response.

Before being declared a winner, each selected entrant will be required to sign a Declaration and Release form confirming compliance with the contest rules and acceptance of the prize as offered and (i) releasing the Sponsor and its parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents and sponsors from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from and (ii) granting Sponsor and its representatives and agents the unrestricted right, in their collective or individual discretion, to publish without any further compensation the name, picture, portrait, likeness, voice and ideas of that entrant for advertising and promotional purposes. The declaration and release form must be returned within five business days of the notification date indicated on the documents or the selected entrant may be disqualified and the prize forfeited.

2. All Entries become property of the Sponsor upon receipt and will not be returned and no correspondence will be entered into except with selected entrants.
3. Any attempt to deliberately damage any ballot box or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
4. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mutilated, forged, falsified, altered or tampered with in any way.

INDEMNIFICATION BY PARTICIPANTS

By entering the Contest, Entrant: (a) releases and holds harmless Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors, depot owners and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, or participating in any prize-related activity; and (b) agrees to fully indemnify Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all claims by third parties without limitation.

CONDUCT

By entering this Contest, entrants agree to be bound by these rules, which will be posted at the Contest website (www.return-it.ca) throughout the entry period. Entrants further agree to be bound by the decisions of the judges, which shall be final and binding in all respects. Sponsor reserves the right, in its sole discretion, to disqualify any entrant it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest or the Contest ballot boxes (b) violating the contest rules; (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY BALLOT BOX OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO IMMEDIATELY SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATION OF LIABILITY

Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry). Sponsor is not responsible for any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any injury or damage to entrants’, or to any other person’s, computer related to or resulting from participating or downloading materials in this contest. If, for any reason, the contest is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.

PRIVACY

By entering the Contest, each entrant agrees to the Sponsor’s use of the entrant's personal information for the purposes of administering this Contest.

LAWS

These are the Official Contest Rules. This Contest is subject to all federal, provincial and municipal laws and regulations. These Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor.

TERMINATION

Sponsor reserves the right to amend or terminate all or any portion of this Contest at any time for any reason without prior notice should any factor beyond the reasonable control of the Sponsor interfere with Sponsor’s ability to administer the Contest as planned.
